Is the HOA responsible for the roof of a townhome?

In most Florida townhome communities the HOA covers the roof, but Chapter 720 of the Florida Statutes does not set a default rule. Responsibility is decided by your community’s recorded declaration of covenants (the CC&Rs) and bylaws. Townhome CC&Rs commonly assign exterior maintenance, including the roof, to the association, while condo-style associations governed by Chapter 718 almost always do. Detached single-family homes inside an HOA usually leave the roof to the individual owner. Read the “Maintenance Responsibility” section of your CC&Rs, or request a copy from your property manager before assuming.
